<p>Doesn&#8217;t government have anything better to do with its time than try to regulate your beer? Apparently Ohio legislators have too much time on their hands.</p>
<p>Ohio <a href="http://www.legislature.state.oh.us/bills.cfm?ID=130_SB_48">Senate bill 48 </a>was introduced Feb. 20 of this year and sent to the House on March 21. It received a single hearing by the House, which amended it, it was then approved by the House and Senate and sent to Ohio Governor John Kasich for signature. He<a href="http://news.cincinnati.com/article/20130430/BIZ/305300001/Kasich-signs-bill-lowering-permit-fee-small-brewers"> signed the bill into law</a> on April 23.</p>
<p>At first glance it appears to be fairly benign, setting up a two-tiered system for licensing which would allow smaller breweries to sell retail directly and bypass wholesale distributors. But digging deeper shows a completely different story. <a href="http://thurbersthoughts.blogspot.com/2013/04/wheres-beer.html">From Thurber&#8217;s Thoughts:</a></p>
<blockquote><p>It does a number of others things, but one aspect generated some controversy: it prohibits large brewers from owning a distributor.</p>
<p>And that was a problem for many, but especially Anheuser-Busch InBev which has numerous options to purchase, or determine the purchaser, of distributorships throughout the state. So they objected to the terms of the bill &#8211; and the rapid process with which it was passed.</p></blockquote>
<p>Now, the Ohio legislature is trying yet again to unnecessarily intervene in the free market and pick winners and losers in the marketplace.</p>
<p>Anheuser <a href="http://www.scribd.com/doc/143438263/Batchelder">sent this letter</a> to Ohio Speaker Batchelder :</p>
<blockquote><p>“The buying and selling of distributorships is the natural movement and realignment of a vibrant, competitive marketplace. MillerCoors wants you to abandon a long-held principle that government has no business picking winners and losers in the private marketplace, and instead is asking you to put a heavy thumb on the scale in their favor to compensate for MillerCoors’ own business decisions.”</p></blockquote>
<p>MillerCoors does not, as a part of its business strategy, purchase distributorships, yet it is asking the government to prohibit other competitors from doing so. From Anheuser&#8217;s letter comes more:</p>
<blockquote><p>“MillerCoors has elected as a part of its business strategy not to purchase and own distributorships in Ohio despite being free to do so. Anheuser Busch has utilized a different strategy…now MillerCoors, presumably because its strategy isn’t working, asks you to change the rules.”</p></blockquote>
<p>Specifically, MillerCoors wants the government to force Anheuser Busch to divest itself from distributors that it already owns. <a href="http://www.scribd.com/doc/143438368/Correspondence-From-MillerCoors">In a letter</a> from Paul Lucas of MillerCoors to the Ohio Senate president Keith Faber:</p>
<blockquote><p>“This further expansion represents a major threat to the health of MillerCoors in Ohio and could create a permanent, statutory competitive disadvantage for the company and its independent MillerCoors wholesale distributors.&#8221;</p></blockquote>
<p>In reality, MillerCoors is asking for the Ohio legislature to side with them and intervene in the free marketplace; the government should not be picking sides or winners and losers. See Anheuser&#8217;s fears:</p>
<blockquote><p>“MillerCoors’ adds insult to injury, knowing that if it gets you to side with its business, the two Anheuser Busch distributorships in question will be substantially devalued because the marketplace will know that Anheuser Busch is being forced by law to sell. This kind of intrusion into private business should not be the job of the government.”</p></blockquote>
<p>So the bottom line is there are two separate issues here. The first one is the original bill, SB 48, which prohibits brewers from buying distributors. Anheuser Busch was against it, since they own distributorships. MillerCoors was for it, since they don&#8217;t own any and it&#8217;s not part of their business model.</p>
<p>The second issue is the one we&#8217;re dealing with now. Distributorships already owned by Anheuser Busch, including one in Canton (the one in question here) were grandfathered in under the bill, and Anheuser Busch is trying to buy more before the legislation takes effect.</p>
<p>MillerCoors is basically asking the government to force Anheuser Busch to sell the distributorships that they already own and prohibit them from buying more before the law takes effect, claiming an unfair competitive advantage.</p>
<p>The irony is that the only reason it&#8217;s an &#8220;unfair advantage&#8221; is because MillerCoors pushed for the law in the first place. They&#8217;re essentially using the Ohio legislature as their company&#8217;s legal arm, trying to change the rules.</p>
<p>Evidently legislators in Ohio are not in favor of a free market where beer companies are allowed to purchase distributorships if they so please.</p>

<h2>An open letter on the Senate immigration bill.</h2>
<p>We write to express our serious concerns regarding the Gang of Eight&#8217;s immigration bill, S. 744. We oppose this bill and urge you to vote against it when it comes to the Senate floor. No matter how well intentioned, the Schumer-Rubio bill suffers from fundamental design flaws that make it unsalvageable. Many of us support various parts of the legislation, but the overall package is so unsatisfactory that the Senate would do better to start over from scratch.</p>
<p>We have a variety of concerns; some of us share only one, others share all. Among these concerns are that the bill:</p>
<ul>
<li>Is bloated and unwieldy along the lines of Obamacare or Dodd-Frank;</li>
<li>Cedes excessive control over immigration law to an administration that has repeatedly proven itself to be untrustworthy, even duplicitous;</li>
<li>Legalizes millions of illegal immigrants before securing the borders, thus ensuring future illegal immigration;</li>
<li>Rewards law breakers and punishes law enforcement, undermining the rule of law;</li>
<li>Hurts American job-seekers, especially those with less education;</li>
<li>Threatens to bankrupt our already strained entitlement system;</li>
<li>Expands government by creating new bureaucracies, authorizing new spending, and calling for endless regulations;</li>
<li>Contains dangerous loopholes that threaten national security;</li>
<li>Is shot through with earmarks for politically connected interest groups;</li>
<li>Overwhelms our immigration bureaucracy, guaranteeing widespread fraud.</li>
</ul>
<p>Reforming our immigration system is an important priority. But S.744 is such a defective measure that it would do more harm than good. We urge you to vote against it and against any cloture vote to bring up the bill. Only then can a constructive, measured debate take place on how to improve America&#8217;s immigration policy.</p>

<p>“If you think it’s uncomfortable sitting over there,” Kelly told former IRS Chief Steve Miller as he grilled him over revelations the IRS targeted “tea party” and “patriot” groups for heightened scrutiny on tax-exempt status applications, “you ought to be a private individual when the IRS is across from you asking you questions.</p>
<p>“I have to tell you,” Kelly said to Miller, who resigned on Wednesday at the request of the White House, “where you’re sitting, you should be outraged. But you’re not.</p>
<p>“The American people should be outraged, and they are,” he continued. “This reaffirms everything the American public believes. This is a huge blow to the faith and trust the American people have in their government. Is there any limit to the scope of where you folks can go?”</p>
<p>Kelly refused to accept the Obama administration’s defense, that the abuses were simply the actions of some rogue underlings in a Cincinnati office of the IRS.</p>
<p>“When the IRS comes in, you’re not allowed to be shoddy, you’re not allowed to be run horribly, you’re not allowed to make mistakes, you’re not allowed to do one d— thing that doesn’t come in compliance,” Kelly blasted. “If you do, you’re held responsible right then.”</p>
<p>When Kelly concluded with the words, “This is absolutely an overreach, and this is an outrage for all America,” the gallery erupted in applause.</p>

<p>“Would that be an inappropriate question to a 501 c3 applicant?” asked Schock. “The content of one’s prayers?”</p>
<p>“It pains me to say I can’t speak to that one either,” Miller replied.</p>
<p>After Schock pressed him further, Miller explained that although he couldn&#8217;t comment on the specific case, it would &#8220;surprise him&#8221; if that question was asked.</p>

<p>In February of 2012 I was asked to be part of a team to investigate the IRS slow-walking of tax exempt status requests and what soon became the <a href="http://www.nationalreview.com/corner/347950/mistakes-were-made?utm_source=twitterfeed&amp;utm_medium=twitter">apparent harassmen</a>t of Conservative groups and Tea Parties.</p>
<p>As the demand letters from the IRS poured in asking for voluminous information such as group members, copies of Facebook pages, who speakers were, copies of website pages, etc. it appeared these groups had been targeted in an election year probably to deplete funds and time. The IRS has been used for political purposes for years but this raises the question whether and if any person or group disagrees with the federal government could they be targeted for audit or worse.</p>
<p>Interestingly enough the IRS letters originated from the same office and were signed by the same personnel no matter what state the liberty group was in: HI, OH, KY, TX, VA, NJ and more. And that office was in Cincinnati, Ohio.</p>
<p>My last entry is <a href="http://conservative-outlooks.com/2012/04/10/congressmen-issa-jordan-probe-irs-scrutiny-of-tea-parties/">here </a>and one can backtrack to the beginning. Leading the charge was former Ohio Liberty Council (now Ohio Liberty Coalition) president Tom Zawistowski. Through the efforts of many Tea Party leaders and with the assistance of crack liberty defender Jay Sekulow and his<a href="http://aclj.org/free-speech-2/irs-admits-targeting-conservative-groups-apologizes"> American Center for Liberty and Justice </a>the ball started rolling with Congressional representatives including Darrell Issa and Jim Jordan sending &#8220;demand letters* to the IRS asking them to respond to these unusual intrusions and questions asked by the IRS. The Congressional representatives gave the IRS the same amount of time to respond as *they* gave the Tea Parties and other liberty groups: about two weeks and using the same language as the IRS.</p>
<p>The Ohio Liberty Coalition stated to the IRS they would not comply with the demands and finally got their tax exempt status in December of 2012. About one month after the election. Coincidence maybe, but: Out of the blue on May 10 of this year IRS agent Lois Lerner, who heads the tax-exempt unit,<a href="http://www.cbsnews.com/8301-18563_162-57584007/irs-apologizes-for-targeting-tea-party-organizations/"> issued an *apology*</a> to these liberty groups:</p>
<blockquote><p>At a lawyers&#8217; conference in Washington, Lois Lerner, a senior IRS career employee who overseas tax exempt organizations, admitted that agency employees singled out particular groups for extra scrutiny using key words with political overtones. &#8221;They used names like tea party or patriots. And they selected cases simply because the application had those names in the title. That was wrong. The IRS would like to apologize for that,&#8221; said Lerner.</p></blockquote>
<p>But this contradicts testimony of former IRS Chief Douglas Schulman who stated:</p>
<blockquote><p>&#8220;There&#8217;s absolutely no targeting. This is the kind of back-and-forth process that happens when people apply,&#8221; said Shulman.</p></blockquote>
<p>Tom Zawistowski issued this statement via email:</p>

<div>Tom Zawistowski, Executive Director of the Portage County TEA Party and recent Past President of the Ohio Liberty Coalition, which first refused to comply with the IRS demands for information in February of 2012, said &#8220;We will accept Ms. Lerner&#8217;s apology as being appropriate, because what the IRS did was wrong and we proved it was wrong.  However, we can not accept her statement that this attack on our organizations and our liberty was orchestrated by low-level IRS employees in the Cincinnati office. We have proof that the same questions were being asked of groups from Virginia to Hawaii.  We have further proof that agents admitted that they were being told by &#8220;higher ups&#8221; not to process applications from &#8220;TEA Party Groups&#8221;.  Our legal representatives, the American Center for Law and Justice, has information from groups all over the nation that substantiate this pattern of abuse.&#8221;</div>

<div>Reps. Issa and Jordan issued this statement via email:</div>
<blockquote><p>WASHINGTON- Ahead of an impending report by the Treasury Inspector General for Tax Administration (TIGTA), the Internal Revenue Service today disclosed that it had targeted certain tax-exempt organizations for their political beliefs. House Oversight and Government Reform Committee Chairman Darrell Issa, R-Calif., and Subcommittee Chairman Jim Jordan, R-Ohio., requested the IG look into allegations of political retaliation last June. In response to the today’s disclosure and apology by IRS, Issa and Jordan issued the following statement: “The fact that Americans were targeted by the IRS because of their political beliefs is unconscionable. The Committee will aggressively follow up on the IG report and hold responsible officials accountable for this political retaliation.”</p></blockquote>
<p>This story which broke on a Friday afternoon in the midst of the Benghazi debacle made more headlines, with the AP, CBS and even NBC picking it up than it did when the original complaints originated last year.</p>
<div>Zawistowski and the ACLJ are now seeking to pull together a class action suit with Liberty groups to sue the IRS for monetary damages incurred for expenses *to comply.* Several Tea Parties even had to fold under the onerous demands.</div>

				<content:encoded><![CDATA[<p>The anti-fracking film Gasland<em> Part II</em> debuted last weekend at the Tribeca Film Festival. The original <em>Gasland</em> was thoroughly debunked by energy scientists and industry experts, revealing the film maker, Josh Fox’s, initial effort relied upon faulty research if not deliberate distortions of the truth. Since <em>Gasland</em> first aired on HBO in 2010, even more research has confirmed the safety of natural gas drilling. <em>Gasland Part II</em> is expected to follow the same distortions presented in <em>Gasland</em> and Fox’s equally discredited propaganda short, <em>The Sky is Pink,</em> doubling down on wrong.</p>
<p>Myths from Gasland:</p>
<p>MYTH: “What I didn’t know was that the 2005 energy bill pushed through Congress by Dick Cheney exempts the oil and natural gas industries from the Clean Water Act, the Clean Air Act, the Safe Drinking Water Act&#8230;and about a dozen other environmental regulations.”</p>
<p><a href="http://www.energyindepth.org/wp-content/uploads/2010/06/Gasland-Fact-Sheet-FINAL-062110.pdf">THE FACTS:</a></p>
<p>· The oil and natural gas industry is regulated under every single one of these federal laws — under provisions of each that are relevant to its operations.</p>
<p>· The 2005 energy bill was supported by nearly three-quarters of the U.S. Senate, including then-Sen. Barack Obama of Illinois. In the U.S. House, 75 Democrats joined 200 Republicans in supporting the final bill.</p>
<p>MYTH “Fracking chemicals are considered proprietary.”</p>
<p>THE FACTS:</p>
<p>· The entire universe of additives used in the fracturing process is known to the public and the state agencies that represent them.</p>
<p>· Not only do individual states mandate disclosure, the federal government does as well. The Occupational Safety and Health Administration (OSHA) mandates this information be kept at every wellsite, and made readily available to response and medical personnel in case of an emergency.</p>
<p>MYTH: “The fracking itself is like a mini-earthquake&#8230;. In order to frack, you need some fracking fluid — a mix of over 596 chemicals.”</p>
<p>THE FACTS:</p>
<p>· The fracturing process uses a mixture of fluids comprised almost entirely (99.5%) of water and sand. The remaining materials, used to help deliver the water down the wellbore, are typically found and used around the house. The average fracturing operation utilizes fewer than 12 of these components, according to the Ground Water Protection Council — not 596.</p>
<p>· Over the course of its history, fracturing has not only been used to increase the flow of oil and natural gas from existing wells, but also to access things like water and geothermal energy. It’s even been used by EPA to clean up Superfund sites.</p>
<p>GENERAL MYTHS ABOUT FRACKING:</p>
<p>MYTH: Flaming water is the result of natural gas drilling</p>
<p>THE FACTS:</p>
<p>Colorado regulators issued a detailed <a href="http://cogcc.state.co.us/library/GASLAND%20DOC.pdf">refutation</a> of the alleged link between shale drilling and flammable well water portrayed in the flawed documentary, <a href="http://www.energyindepth.org/debunking-gasland-2/">“Gasland.”</a> They noted that naturally occurring biogenic methane, unrelated to drilling, was the cause of flammable well water.</p>
<p><a href="http://www.propublica.org/article/colorado-study-links-methane-in-water-drilling-422">ProPublica explained,</a> “Drinking water with methane, the largest component of natural gas, isn&#8217;t necessarily harmful. The gas itself isn&#8217;t toxic &#8212; the Environmental Protection Agency doesn&#8217;t even regulate it &#8212; and it escapes from water quickly, like bubbles in a soda.”</p>
<p>Methane-borne water is actually a naturally occurring phenomenon with which even<a href="http://books.google.co.uk/books?id=aP9bAAAAQAAJ&amp;pg=PA181&amp;lpg=PA181&amp;dq=Thomas+Paine+When+the+mud+at+the+bottom+was+disturbed+by+the+poles,+the+air+bubbles+rose+fast&amp;source=bl&amp;ots=lcKEvj7rST&amp;sig=FUwDhoA6cjPukpmrQsRGq7mjDso&amp;hl=en&amp;sa=X&amp;ei=WFcVT_vhKKKL4gTU1YT4A#v=onepage&amp;q&amp;f=false"> Gen. George Washington</a> experimented in 1783 when he ignited New Jersey’s Millstone River.</p>
<p>MYTH: Drilling is contaminating groundwater</p>
<p>THE FACTS:</p>
<p>Claims of groundwater contamination have been so <a href="http://www.pennlive.com/midstate/index.ssf/2012/07/epa_says_dimock_water_is_safe.html">deeply flawed</a> that even Environmental Protection Agency administrator Lisa Jackson has publicly and categorically refuted them.</p>

<p>THE FACTS:</p>
<p>Michelle Bamberger, an Ithaca, New York, veterinarian, and Robert Oswald, a professor of molecular medicine at Cornell’s College of Veterinary Medicine, published an <a href="http://ia700801.us.archive.org/1/items/ImpactsOfGasDrillingOnHumanAndAnimalHealth/Bamberger_Oswald_NS22_in_press.pdf">article</a> suggesting a link between hydraulic fracturing and illness in food animals.</p>
<p>The piece is decidedly <a href="http://www.energyindepth.org/cornell-veterinarians-go-into-beast-mode-on-shale/">unscientific,</a> providing neither data nor independent corroboration to support their assertions.</p>
<p>Energy In Depth notes that Dr. Ian Rae, a professor at the University of Melbourne in Australia and Co-chair of the <a href="http://www.unep.fr/ozonaction/montrealprotocolwhoswho/PageFlip.asp?getId=245">Chemicals Technical Options Committee</a> for the United Nations Environment Programme,<a href="http://theconversation.com/gas-drilling-research-highlights-risk-to-animals-but-more-thorough-work-needed-4902"> called</a> the paper “an advocacy piece” that suffers from poor referencing, and the authors themselves “cannot be regarded as experts” in the field in which they are commenting.</p>
<p>MYTH:  Natural gas drilling as a process that’s laced with harmful chemicals</p>
<p><a href="http://www.energyindepth.org/wp-content/uploads/2010/06/Gasland-Fact-Sheet-FINAL-062110.pdf">T</a>HE FACTS:</p>
<p>Even while states are moving to join those which already require disclosure of substances used in hydraulic fracturing, the industry routinely uses the online database <a href="http://fracfocus.org/">FracFocus.org.</a> Any visitor to the site can find out additives are being used at any well site in the database.</p>
<p>Typically, water and sand account <a href="http://www.energyindepth.org/frac-fluid.pdf">99.5 percent</a> of the mix. One of the most frequently used substances in the other one-half of one percent is guar gum, a food thickening agent found in everything from ice cream to pudding.</p>
<p>In a related story, Yoko Ono, Matt Damon and Sean Lennon have <a href="http://conservative-outlooks.com/2013/01/03/celebs-join-the-anti-fracking-bandwagon/">gone on the warpath</a> against fracking in New York. Their group called <em>Artists Against Fracking </em><a href="http://www.foxnews.com/politics/2013/03/30/ny-lobby-board-asked-to-investigate-yoko-ono-other-artists-against-fracking/">is being investigated</a> on lobbying violations at the request of The Independent Oil and Gas Association. This sign has been erected in New York by the pro-fracking group &#8220;Frack Nation&#8221;:</p>

<p>Once you get yourself in quicksand and start flailing around, the harder it is to extricate yourself.</p>
<p>That&#8217;s exactly what seems to be happening with the campaign of Virginia Democratic gubernatorial candidate and former DNC Chair Terry McAuliffe.</p>
<p>McAuliffe&#8217;s troubles began in 2009 with a failed Virginia gubernatorial run. He then became chairman of a car company called Green Tech which was <em>supposed </em>to manufacture golf-cart size cars, as shown in picture above, which run on electricity.</p>
<p>But he didn&#8217;t plan to build the plant in Virginia, but instead in Mississippi after then Mississippi republican Governor Haley Barbour <a href="http://online.wsj.com/article/SB10001424127887323741004578416821313987276.html?mod=WSJ_Opinion_LEADTop">promised to grant $5 million</a> in public loans to build the plant. McAuliffe was questioned as to <em>why</em> he didn&#8217;t plan to build the plant in his home state of Virginia, and his excuse was Virginia didn&#8217;t want to bid on the program. However news outlets later discovered Virginia claimed they never received enough information from McAuliffe in order to proceed. Not only did Virginia claim they didn&#8217;t receive enough information, apparently worries began in the Virginia Economic Development Partnership (VEDP) not only did McAuliffe have a risky business model but the real goal  was to use the company to sell wealthy foreigners business visas under the U.S. EB-5 program.</p>
<p><a href="http://www.nationalreview.com/articles/345255/virginia-s-fears-visa-sale-scheme-jim-geraghty">NRO reveals</a> internal communications within VEDP:</p>
<blockquote><p>Sandi et al. Even if the company has investors “lined up”, I maintain serious concerns about the establishment of an EB-5 center in general, and most specifically based on this company. Not only based on (lack of) management expertise, (lack of) market preparation, etc. but also still can’t get my head around this being anything other than a visa-for-sale scheme with potential national security implications that we have no way to confirm or discount. . . .</p>
<p>This “feels” like a national political play instead of a Virginia economic development opportunity. I am not willing to stake Virginia’s reputation on this at this juncture.</p></blockquote>
<p>Under the federal EB-5 program a foreigner must invest at least $1 million or $500,000 in a rural area. Many of the visa recipients come from China. While the visa centers cannot <em>sell</em> visas, they can direct an investor on the procedure and projects available to obtain them.</p>
<p>Gulf Coast Funds Management LLC is a company which handles EB-5 projects and it&#8217;s interesting<a href="http://www.gulfcoastfunds.com/portfoliocompanies/"> one of their clients</a> is Green Tech. The plant has never been built and in February of 2013 it was revealed McAuliffe had stepped down as chairman with nary a peep to anyone outside the company. Not only is he no longer chairman but the company is reportedly being hit with a large tax bill of $17,000 in Tunica Cty Mississippi which was due February 1 <a href="http://blogs.nbc12.com/decisionvirginia/2013/04/questions-surround-missing-tax-payment-from-mcauliffes-greentech.html">and was delinquent for 3 months</a>. Green Tech is exempt from property tax for 10 years, however this tax bill was for small start-up office space.</p>
<p>So no plant, no jobs and no cars. As of yet. Supposedly they will be available late 2013 or in 2014.</p>
<p>McAuliffe&#8217;s opponent, Virginia Republican and present Attorney General Ken Cuccinelli <a href="http://cuccinelli.com/why-would-anyone-ask/">had this to say</a> about McAuliffe&#8217;s failure to inform the public he had stepped down from Green Tech:</p>
<blockquote><p>Terry McAuliffe on Saturday claimed he wasn’t being shady by silently stepping down as Chairman of GreenTech. In fact, he went as far as to say that he, “told everyone who asked,” he no longer held the position.</p>
<p>Why would anyone ask?</p>
<p>Not only did numerous news articles go uncorrected, but he continued to speak as if he was chairman and was referred to as “chairman” in a GreenTech release after his resignation.</p>
<p>Bottom Line: McAuliffe deceived the people of Virginia. What else is Terry hiding?</p></blockquote>
<p>And this came to light yesterday. <a href="http://watchdog.org/79437/mcauliffe-car-company-sues-watchdog-in-libel-claim/">Green Tech is suing Watchdog.org</a> for alleged libel, complaining they were responsible for an $85 million loss by the company after reporting on Green Tech&#8217;s troubles:</p>
<blockquote><p>“Specifically, as a direct and express result of the articles published by Defendants … investors are wavering in their commitment to provide $25 million in investments already promised to GTA,” the lawsuit said. “GTA…intended to raise $60 million in capital, (and) is now in significant danger as a direct result of the loss of investor confidence in GTA arising from the publication of Defendants’ articles.”</p></blockquote>
<p>Watchdog claims there is no basis for the suit.</p>
<p>Perhaps Cuccinelli <a href="https://donate.terrymcauliffe.com/page/contribute/donate">should shoot one over the bow</a> for this found on McAuliffe&#8217;s website. Notice the bolding:</p>
