Battling bills in the Senate on EPA reform, Dems v. Repubs

For background please see my previous article, “Obama pouts & tries end-run around Congress to pass cap & trade.”

Dueling Senate bills and resolutions on how to rein in the over-reaching EPA could come as early as Tuesday. H/t to Jeff Dunetz at YidwithLid, not only has Obama lost support of The Washington Post for his “energy bill” but my own research has told me he’s lost the support of  the Wall Street Journal as well:

The Environmental Protection Agency debate lands in the Senate this week, amid the makings of a left-right coalition to mitigate the agency’s abuses. Few other votes this year could do more to help the private economy—but only if enough Democrats are willing to buck the White House.

This moment arrived unexpectedly, with Majority Leader Harry Reid opening a small business bill to amendments. Republican leader Mitch McConnell promptly introduced a rider to strip the EPA of the carbon regulation authority that the Obama Administration has given itself. Two weeks ago, Mr. Reid pulled the bill from the floor once it became clear Mr. McConnell might have the 13 Democrats he needs to clear 60.

Those “riders” are per S.493, the Small Business Innovation Research and Authorization Bill which would reduce the size of government. Additional riders provided by Patriot Action Network.

  • McConnell/Inhofe amendment #183 (prohibit EPA regulation of greenhouse gas emissions);
  • Landrieu 2nd-degree amendment #244 (enactment date change) to amendment #183;
  • Vitter amendment #178 (sell unused federal property);
  • Johanns amendment #161 (repeal 1099 reporting requirements);
  • Cornyn amendment #186 (bipartisan commission on oversight and eliminating wasteful government spending);
  • Paul amendment #199 (cut $200 billion in FY 2011 spending);
  • Sanders amendment #207 (point of order re: Social Security);
  • Hutchison amendment #197 (delay implementation of Obama’s health spending bill until pending lawsuits  resolved);
  • Coburn amendment #184 (list of programs administered by every federal department and agency); and
  • Pryor amendment #229 (Patriot Express Loan Program).

Back in January the Dems put out their own legislation to suspend the EPA for 2 years from implementing regulation of greenhouse gas emissions, the EPA Stationary Source Regulations Suspension Act. Manchin & Rockefeller weigh in maybe because…the EPA pulled the permit for a huge already-in-use coal mine in their state of West Virginia and 98% of the electricity in WVA comes from coal.  Guess they don’t want their constituents left in the dark so they make sure they put the “X” next to their names in the next election.  Also on the list are McCaskill, Johnson, Nelson and Conrad.

This stunning quote from “Bloody Mary” Landrieu (D-LA):

“The Fact Remains That Allowing The EPA To Make An End Run Around Congress And Twist The Clean Air Act For This Purpose Would Result In Ever-Changing Regulations And Uncertainty In The Private Investment Market That Would Damage Louisiana’s Already Fragile Economy And Fail To Address The Risks Of Climate Change.”

Even ultra-lib Sherrod Brown isn’t sure how OHIO will be affected, per the Hill:

Brown — who faces reelection in 2012 in the battleground Midwest state — wrote to President Obama Monday calling for a review of the “economic repercussions and potential unintended consequences” of regulations the Environmental Protection Agency (EPA) has begun to phase in this year.

The Journal closes it out by stating:

The McConnell amendment is one of the best proposals for growth and job creation to make it onto the Senate docket in years. If Mr. Obama is intent on defending the EPA’s regulatory assault, then the least Senate Democrats can do is force him to defend his choices himself.

Pay close attention this week folks. Even if it passes the Senate, be sure that Obama will veto it.

Capitol Malpractice: How Zero-care will implode states’ budgets

“Hey, Obambi! We told you Zero-care was gonna place a huge budget problem on the states! But did you listen to us? NO! Now face the consequences and don’t say you are “embarrassed” like you did to all those CEO’s taking charges. We warned you!” John Boehner, Tim Pawlenty, and many more.

Last week I related the story of DC’s impending “Salem Witch Trials.” You know, the one where Waxman is gonna haul all those CEOs asses into Congress to explain why they are taking “charges”? Now I fully expect Obambi to say he’s embarrassed cuz a ton of governors are complaining about their massive budget shortfalls and have Waxman haul their asses into Congress as well.

Thirty three states have already depleted their unemployment funds (thanks to you, Obama) and have been forced to borrow $$ from the Feds. California is at the top of the list, of course, borrowing $8.4 billion. My state, Ohio, hit extremely hard from unemployment, has borrowed $2.23 billion. On the low end, Delaware comes in with borrowing $1 million. Bear in mind this is all before the Zero-care monstrosity will give a one-two punch to all the states with new expensive Medicaid obligations.

Me thinks, Obama, this is all part of your master plan to make the US into a socialist “nanny-state” and force the states to become even more dependent on the Feds. Rahm, you must be really proud.

According to the Wall Street Journal:

New Jersey’s governor, a fiscal conservative, has proposed not making the state’s entire $3 billion contribution to its pension funds because of the state’s $11 billion budget deficit. Virginia has proposed paying only $1.5 billion of the $2.2 billion required pension contribution. Connecticut Republican Gov. M. Jodi Rell is deferring $100 million in payments this year to the pension fund for state .

Here is a FoxNews video from last September warning of this very thing. Even Harry Reid (gasp!) warns that Nevada won’t be able to afford the Medicaid increased costs from the Baucus bill:

“I think the governors would all agree that what we don’t want from the federal government is unfunded mandates,’’ said Governor Jim Douglas of Vermont, [National Governor's Association Chairman] a Republican who is the group’s incoming chairman. “We can’t have the Congress impose requirements that we are forced to absorb beyond our capacity to do so.’’

House Minority Leader John Boehner (R-OH) and Governor Tim Pawlenty (R-MN)  put out this 19 page report named “Capitol Malpractice,” A GOP State Solutions project in July of 2009 warning of impending doom for the states. Eighteen governors have written letters to Senator Baucus and others involved in drafting Zero-care worried about the impact on their states. Here is another video of Rep. Boehner, Rep. Mike Pence (R-IN) and Governor Haley Barbour (R-MS) warning of the dangers of Obama/Pelosi-care for the states:

If states are borrowing from the Feds now to pay unemployment benefits, this must be giving others who receive state pensions nervous tummies. A friend of mine on twitter was warned last summer from her state rep John Carter (R-TX) that a government take-over of all state pensions has at one time or another been bandied about in Congress.

If the Feds try this kind of a money-grab, I can’t predict what the reactions will be.

A Pyrrhic Victory for Obama

I have to admit this pretty much sums up how I feel right now. Over half the citizens of America are worn out from the rallies, the Tea Parties, the Town Hall meetings, the endless Obama-mercials from the Liar in Chief.

So just like after any battle that is lost, one must take a short rest, re-group and re-strategize.

The Narcissist in Chief thinks he has won. But it will be a short, pyrrhic victory. One which will have a devastating cost to the Victor but the realization is not there.

But that “reality check” will come on November, 2, 2010. We have our eyes on the 219 who voted for Zero-care in the House. We have our eyes especially on the seats of Pelosi, Frank, Reid, Boxer, Stupak, Lincoln and in my district Kaptur. I can’t wait to see the look on all their faces when the polls come in to say:

Guess what, you guys! You’re done! Gone! Finito! Acabo! Sayonara! Arrivederci!

This will be the cost of “failure to listen to your bosses.” After all, it is us who signs your paycheck. And we are not pleased. Your arrogance and hubris have astounded us. You fought us, we lost. Now you are still crying, because we are angry that you have not represented our wishes.

But have no fear. WE THE PEOPLE will speak loud and clear in November. And your “victory” will be extremely short-lived.

First they ignore you, then they laugh at you, then they fight you, then you win.

ZERO-CARE NOW “LAW OF THE LAND”

Flanked by Pelosi, Reid, Biden et al, with the flourish of the pen, and the pomp and circumstance reserved only for high school and college graduations, the “Socialist in Chief” signed Zero-care into law.

Our country has now officially taken one step further towards socialism.

In an e-mail I received yesterday from The One, inviting me to be a “cosigner” (I declined), he stated:

Its an historic expansion of insurance coverage reforms that generations of Americans have fought for and marched for and hungered to see.

As Glenn Beck stated on his television program yesterday,

Pelosi & large gavel - downfall

The arrogance and prescience of Madame Pelosi marching into the House before the vote session last Sunday should be reserved only for Latin American or African dictators who know ahead of time their “law” is going to be passed.  I can think of something else I would love to use that huge gavel for, but that thought is reserved for only my close personal friends.

How many of you KNOW up to $16,000 new IRS workers will be hired to “police” Obamacare?

How many of you KNOW up to 43% of primary care docs are expected to retire or find a new line of work causing more difficulty in obtaining care?

How many of you KNOW the fine for employers to NOT offer employee coverage is only $250 and it’s likely many will elect to pay the fine instead of providing the insurance, thus throwing potentially millions of workers into the government pool?

How many of you KNOW Medicare will be cut by $500 billion, thus coercing the remaining number of primary care docs to drop Medicare patients because of the low re-imbursement?

How many of you KNOW the “Student Loan” provision included will prohibit EVERY BANK in the US from offering student loans,  except for ONE BANK in South Dakota whose district Congressman took a kickback for a “yes” vote?

How many of you KNOW the “Executive Order” signed by Obama to cut abortion funding out of the law is “not law” and can be rescinded at any time; and that abortion coverage is still in the law, but well hidden?

And how many of you KNOW this mockery of a LAW was designed DELIBERATELY to be “phased in” thus hiding the actual cost?

If you thought it was hard now trying to get a hold of your insurance company, wait until you have to call HHS in DC!

But in spite of all the above, we have just begun to fight. America is resilient. We may have lost the battle, but certainly not the war. Because remember this historic event?

“Hey, Let’s Not Get Hung Up on the Process..”

Well, folks. We might as well send our Constitution to Russia, or China, or Iran. Because frankly, the people in DC just aren’t using it anymore. They have wadded it up, and thrown it in the trash like a piece of garbage.

And this coming from the Constitutional Lawyer in Chief:

Let me be perfectly clear. I know the Constitution says a bill can’t become a law without passing both Houses of Congress. But let’s not get hung up on the process. We can just do what we want, use the Slaughter Rule and use the “deem and pass” trick.  No one is gonna notice. That piece of paper is so old anyhow. [my words].

If I recall, Mr. Obama. When you were sworn into office, you took an oath to uphold that “old piece of paper.”

And I’ve got news for you Mr. Obama. There are tons of lawsuits waiting-in-the-wings to challenge this should you really go ahead and try it. Including Mark Levin. Just like a good Boy Scout, he is prepared and has a draft of his suit already to go.

Update from Gretawire at 1:20pm: Democratic Rep. Alcee Hastings (Fla.) just said this (120 pm) in the most powerful committee of the United States House of Representatives. The people’s house:

“There ain’t no rules here, we’re trying to accomplish something. . . .All this talk about rules. . . .When the deal goes down . . . we make ‘em up as we go along.”

I would tell you I’m shocked, but I’m not…

Republicans can’t beat this bill. But the American people can. It’s not too late to make your voice heard.

And finally, seems the  Senate Democratic leaders have decided they will not publicly release a health care reform letter signed by their rank and file intended to calm nervous House Democrats before their historic vote this weekend on the comprehensive Senate-passed measure and a budget reconciliation bill of fixes.
